Is This Outrageous or About Right?

Richard Winton at LATimes.com reports that a guy in his 30s caught molesting his 13-year-old goddaughter (police think it started when she was 12) has been sentenced to just three years in state prison after pleading no context to two felony counts (two other counts were dismissed). And if you know anything about the current situation with prisons in California, he's probably gonna get out plenty early, after spending the most of the time in county jail.

Wait...

Let me check that again...

Oh!

I knew something had to be wrong with that. I didn't think a guy would get only a three year sentence for something like that. It wasn't a guy with his goddaughter – it was a woman with her godson. This is an update on a story I noted on here before:

The operator of a South Los Angeles day-care center convicted of molesting her 13-year-old godson was sentenced Tuesday to three years in state prison.

Los Angeles Superior Court Judge Terry Bork sentenced Chelsea McClelland, 35, to state prison and ordered her to register as a sex offender for the rest of her life for the assaults that occurred in December 2010.

So much for "thirteen will get you twenty".

Homeless Guy Scores Jailbait

What am I missing here? Tony Barboza reports at LATimes.com.
A registered sex offender living in a tent in Moreno Valley has been arrested on suspicion of having sex with two underage girls, police said Tuesday.

James Russell Watkins, 29, was arrested Saturday after police responded to a tip about a possible sexual assault of two teenage girls near Alessandro Boulevard and the Old 215 Freeway.

He was arrested, essentially, for statutory rape. He's not being charged with forcible rape, or kidnapping, or unlawful detention.
After interviewing Watkins, police said, they determined he had had intercourse with the girls at various times throughout July.

So, not twice, as in once with each girl. Various times.
Watkins, a parolee and registered sex offender who told police he lived in a tent in the area, was booked on charges of unlawful sexual intercourse, child abuse and violation of parole.

Okay. So it sounds like the girls willingly had sex with him. I know, they are too young to consent and I'm in no way defending this creep. But what's up with these girls? I would think they were junkies, but there's nothing about him being charged with supplying them with anything. That implies to me that these girls were willingly visiting this guy for sex.

I remember when one of the reasons young guys wanted a nice car was score with the young women. This guy is a bum. What's going on with these girls? If they wanted sex, they could no doubt get it with guys who aren't homeless. There's something missing here. And what are the odds these girls aren't from homes with good fathers? Fairly high, I'd think.

Amish Brothers Accused of Doing Bad Things

...to kids and with animals. The text of this story not for the squeamish.

Where's a good Harrison Ford movie when you need one?

In Grant County, Wisconsin, the authorities believe that two Amish brothers have been doing some very evil and disturbing things, including incestuous molestation and beastiality.

Authorities issued two criminal complaints on Tuesday for the men -- Christian G. Stolzfus, 19, of Fennimore, and Dannie G. Stolzfus, 18, of Fennimore. They were the subjects of a three-month investigation by the Grant County Sheriff's Department and the county's Department of Social Services.

The men face charges involving at least six different family members and multiple animals.

Christian Stolzfus is charged with repeated sexual assault of a child, four counts of first-degree sexual assault of a child under the age of 13 without great bodily harm; attempted first-degree sexual assault of a child under the age of 13 without great bodily harm; two counts of incest; exposing genitals or pubic area; and two counts of sexual gratification with an animal. Authorities said that they believe these incidents occurred during a four-year period.

Dannie Stolzfus is charged with two counts of incest and sexual gratification with an animal. Authorities said that they believe these incidents occurred over a three-year period.
And how old were the victims?

Authorities said the victims, at the time, ranged in age from 5 to 16 years old.
And what animals were involved?

Govier said that that the animals allegedly involved were a cow and a horse.
Try a rattlesnake next time.

Now this is probably the most unbelievable line in the story:

The two men have not yet been arrested. Instead, the Grant County Sheriff's Department said they will be summoned to court to face the charges against them.
HUH?!?

If convicted of the charges, Christian Stoltzfus faces more than of 400 years in prison. Dannie Stoltzfus faces nearly 90 years in prison, if convicted.
I see... no need to arrest them because hey, there's a chance they won't have to spend the rest of their lives in prison, so they're not a flight risk, right? Sheesh. I hope all kids are being kept away from them.

This is not in anyway to excuse these guys, because they should definitely go away for a long time if they did these things, but my guess is that someone did something to these guys when they were younger. Is that person still alive and free?

Let's lighten it up a bit now...

Fresh From the Spring

So a guy's semen is found in a coworker's water bottle in the OC. At first, I thought he was guilty for sure. Here's how the LATimes.com blogger Richard Winton put it:

An investment company executive was arrested Tuesday after DNA recovered from a female co-worker's water bottle revealed he allegedly put semen into a bottle that she later drank from, prosecutors say.
That is not well written - "revealed he allegedly"? How about, "An investment company executive was arrested Tuesday for allegedly placing his semen in a female coworker's water bottle. Prosecutors say the semen matched his DNA."

Now, I figured the guy was cooked, but as "Scott" pointed out in the comments at August 18, 2010 at 11:01 AM, she could have obtained the semen another way, and placed it in the bottle herself.

Michael Kevin Lallana, 31, of Fullerton…was charged with two misdemeanor counts of releasing an offensive material in a public place and assault on two separate occasions.
Two times?

The first incident allegedly occurred Jan. 14 when Lallana and the woman worked in the company's Newport Beach office. On that day, he left a semen-laced bottle of water on the victim's desk, and when she returned later, she drank from it.
Hold on a minute. Was it a bottle she left there, opened? Who goes back to their desk and drinks from an opened water bottle that they didn’t leave there, or didn’t leave there opened?

She fell ill and threw the bottle away, prosecutors said.
As "Scott" wrote:

There is something wrong with this story. First of all, ingesting semen would not make one sick.
I don't know - some women are highly disgusted by the stuff. Maybe she is allergic.

Three months later, prosecutors claim, Lallana repeated the act…in Orange, where the two had been transferred. The woman, whose identity was withheld by prosecutors, again felt ill. Suspicious of the water’s contents, she sent it to a lab for analysis. In June, the private lab warned the woman that the bottle contained semen.
But they still needed to find the match.

Taghavi said investigators were able to key in on Lallana because he worked at both locations where the incidents occurred. During the investigation Lallana eventually volunteered to provide a sample of his DNA for testing, he said.
Now, either the man is crazy, stupid, or figured he was in the clear because he didn't put his semen into her water bottle.

Taghavi said Lallana and the woman were colleagues, but Lallana had not expressed animosity toward the woman or done anything publicly to suggest he was the perpetrator.
Okay, so back to Scott's comment.

Secondly, unless the woman saved the first bottle of water from the first alleged incident back in January, which she didn't, there is no forensic evidence so where is this first incident information and evidence coming from? Maybe some co-workers were aware of what he had done and came forward? I wouldn't be surprised if it turns out the two of them were having sexual relations and she got fed up for whatever reason and set him up. I mean she could have performed oral sex on him and then deposited his semen in the bottle of water. I don't think he would have voluntarily given a DNA sample if he had done what he is accused of doing. I think there are major holes in this story, another rush to judgement story maybe.
Quite possibly. She could have also had intercourse with him, using a condom, and collected the semen that way. Or maybe she knows he has a habit of masturbating and dropping tissues into a certain waste basket.

Here's what would have to be true for prosecutors to be right:

1. In January, the suspect either masturbated at the victim's desk, or took the bottle somewhere to mb, or mb'd elsewhere and brought the semen to her desk, without her realizing, and without coworkers seeing or with coworkers being in on it.

2. We'll just assume she left an opened water bottle at her desk. She doesn't notice anything wrong with the water in the bottle before she drinks it.

3. She drinks from the bottle and the semen makes her sick, and she believes the contents of the water bottle made her sick.

4. She doesn't keep the bottle, or contact the water company – she just throws it away.

5. Three months later, steps 1-3 happen all over again.

6. She remembers the January instance.

7. Knowing he's guilty, the suspect volunteers a DNA sample.

I suppose all of this is possible. Either he's guilty or she is guilty of setting him up. Whichever it is, someone has done something very wrong.

He Was Teaching More Than English

Shelby Grad reports on LATimes.com that an American man accused of being a "sex tourist" in Cambodia is heading to trial.

Michael James Dodd, 59, was brought from Cambodia to Los Angeles in February. If convicted, he could face up to 30 years in federal prison.
While I want to see child abusers imprisoned, what other crimes do people get tried for here in the states if they commit them elsewhere? I know if two Americans are abroad and one kills the other (or one disappears), the FBI will get involved. And leaders of foreign nations have been convicted in American courts for crimes they directed from their home country. But if someone were to, say, go to Brazil and rob a bank there, and then come back to the states, would the authorities here try that person here? The crimes in cases like this often have to do with travelling abroad to commit these crimes. Does intent have to be shown? I mean, does he get off the hook if he really did go there for business and then, once there, decided to indulge in his perverse desires?

Dodd taught English in Cambodia, had sex with a 14-year-old girl and was seen with her on several occasions in the Cambodian capital of Phnom Penh, according to an affidavit for arrest filed in federal court.
Gross. He should have learned to make movies and gone to live in France.

In 2002, Dodd pleaded guilty in Saipan to five counts of sexual abuse of a child after he was accused of inappropriately touching 13 female students at an elementary school where he taught, an FBI agent said in the affidavit. Dodd served time in prison and was placed on probation for 15 years.
It's only 2010, so he didn't spend much time in prison, did he? Elementary school girls. Ick. Fourteen year-olds are attracted to each other. Elementary school kids get crushes on 14-year-olds. But the only people attracted to elementary school kids are pedophiles.

He also faces criminal charges in Cambodia.
Yeah, but if they don't want to lock him up for very long, let's keep him locked up for a long time here.

Father of The Month

Sarah Burge of the Press-Enterprise reports from the inland area east of Los Angeles:

A southwest Riverside County father accused of tying up and using a stun gun on a 23-year-old man who sent his 17-year-old daughter an explicit cell phone photo pleaded not guilty Friday to assault and other charges.
The paper's headline calls the 23-year-old a "teen prankster". I wasn't aware that 23 was teenaged. And prankster? Please.

Authorities allege that William Atwood Sr., 45, angry over the photo, lured Justin Moore to his home in French Valley. He then ordered him to strip down to his boxer shorts, fired a shotgun in the air, bound him with zip ties and shocked him with a Taser, authorities say. Eventually, he turned him over to a Riverside County sheriff's deputy.
So what's wrong with that?

"We don't authorize people to take the law into their own hands," said Supervising Deputy District Attorney Gerald Fineman. "That's why we have law enforcement."
Well, yeah, government agencies usually don’t advocate people do things for themselves that government agencies are supposed do – like educating children. Okay, so perhaps dealing with sex offenders this way is different.

Moore, who lives in Temecula and knows Atwood's daughter and son, told sheriff's investigators that he had sent a cell phone photo of his genitals to the girl and other friends as a joke.
A joke? Well, I guess it would depend on the size of the subject.

Investigators confirmed that Moore sent the photo to several people, including Atwood's daughter. Prosecutors declined to file charges against him.
Where's Chris Hanson?

Fineman said prosecutors would have to prove the photo was sent with a sexual intent. That does not appear to have been the case, he said.
Really? Huh? Have I missed something?

Fineman said Moore did not send the photo out of the blue. The group of friends, which included Atwood's daughter, had exchanged cell phone photos in the past that might be considered inappropriate.
Ah, I see. So I guess acquaintance rape wouldn't be so bad if they'd engaged in heavy petting on a different date.

Okay, so if the father really did everything alleged, then I could see how some people might think he went a teeny bit too far.

Now, can we lock Roman Polanski in a room with him?

Have You Met Kevin Michael Sianez's Dog?

Sianez is accused of 63 counts...
...ranging from defrauding clients to intimidating witnesses to posting ads on Craigslist seeking women to engage in sex acts with his Labrador retriever.

Kevin Michael Sianez, 53, of Fountain Valley is also charged with illegally operating a private investigation service without a license, according to the Orange County district attorney’s office.
Would you hire this guy?
Investigators also discovered that Sianez posted ads on Craigslist seeking women to engage in bestiality with his dog, prosecutors said, and he tried to set up the meetings through e-mail.

If convicted of all the charges, Sianez faces a maximum of 38 years in prison.
But what does the dog have to say about all of this?

Either he's a really strange and scary guy, or someone is doing an excellent job of setting him up. Investigators go make enemies, after all.

How Does Anyone Get Like This?

From the Altoona Mirror in Altoona, Pennsylvania, comes a tale that even the writers for Law & Order: SVU would find too bizarre to use.

An Indiana County woman has been charged with having sex with a horse, state police at Indiana said Tuesday.
But that's not all.

Dovie Lee Kerner, 46, of Plumville also allegedly had sex with other animals including a dog and a pig, court documents state.
Well, I sure hope those animals are all male. Otherwise, it would be weird.

One of the officials said she received a phone call from a confidential informant who asked her if it was illegal to have sex with an animal. When told yes, the informant said he had a video on his cell phone of Kerner having sex with a horse, court documents state.
Which means he stood there watching.

He probably turned her in because she – believe it or not – had sex with other men. How dare she?

Because of Kerner's alleged sexual activities with other men and animals, the informant, who had dated the woman, and his Jack Russell terrier both contracted sexually transmitted diseases, court documents state.
Poor dog. He was probably thinking, "Hey my human's new girlfriend is cool. She's nice to me. Hey... wait a minute...she's being a little too friendly with me... what's that I smell on her?!?"

What will she tell the other inmates? "Uh, I'm in for murder. Yeah, that's it."

I wonder if she'll have to stay at least 500 feet away from kennels and stables?

The real tip off was when she gave birth to a side of bacon.

You can click here if you really want to see the paperwork.

Kyle Nachreiner - What a Lack of Remorse Looks Like

There was a high-profile criminal case in Orange County, California several years back as three young guys who where politically connected were caught on tape sexually assaulting a girl. Now, one of the convicted criminals was foolish enough to be interviewed, photographed, and videotaped for a story in the Orange County Register, so that he could complain that being registered and labeled as “sex offender” is unfair. Break out the air violins for his situation.

"I went from being in the paper for playing varsity baseball as a freshman to being in the paper for a rape case,'' he says.

Yeah, you blew it. You had a really great launching pad to the rest of your life, and you threw it away.

On July 5, 2002, when he was 17, Nachreiner and two other male teenagers, Gregory Haidl and Keith Spann, sexually assaulted a seemingly unconscious teenage girl in the Corona del Mar home of Haidl's father, then-Assistant Sheriff Don Haidl.
I should note that Haidl was pretty much a political appointee by a Sheriff who has been subsequently criminally convicted himself.

The trio videotaped the episode, a 21-minute movie that shows the friends laughing as they shove a pool cue, a lit cigarette, a juice can and Snapple bottle inside the girl as she lay intoxicated on a pool table.
Geniuses.

In 2006, they were each sentenced to six years in prison.

All three are adults now and out of prison, having served less time because none of the sex offenses were found to be forcible. Last month, they lost their appeal to the California Fourth District Court of Appeal to overturn their convictions and the requirement that they register as lifelong sex offenders.
So they got out early, but he is still pushing his luck.

Nachreiner, though, may appeal his case to the state Supreme Court. He says it is unfair for him to endure the punishment of being tagged as a sex offender until he dies.

"I served my time. I went to prison. Now, I'm stuck with that label."

Yeah, that's how the sex offender registry works.

"Psychologically, it's devastating. It's the worst form of degradation there is."

What an incredibly stupid and callous thing to say, given what someone else has suffered by his actions.

He says he was very drunk, and that alcohol impaired his judgment.

And did somebody force those drinks down your 17-year-old throat?

"I'm responsible for behaving how I did. For hanging out with people I didn't trust ... For being ignorant. She's responsible for going there, for bragging that she's a porn star."

She's responsible for some bad judgment. That does not mean she deserved to be gang-raped.

"I don't believe for one second she was unconscious,'' he says.
Even if she wasn't, and it is hard to believe she wasn't, given what was being stuck in her, you still did a horrible thing. The defense lawyers attempted to slime the victim, too, and he does too...

When asked if he knew what he was doing at the time was wrong, he pauses before answering.

"Had it been any other girl, maybe."

BZZZZZ. Wrong. It was wrong to do to ANYONE. For example, you can bet that if prison guards did it to HIM after he was convicted, they would be prosecuted themselves, and this guy would be suing the county/state.

The three were tried as adults and were almost victorious at their first trial. That trial ended in a deadlocked jury.

Faced with a mistrial, Orange County prosecutors decided to deal. They offered Nachreiner, Haidl and Spann a plea bargain that would have landed each of them in prison for 18 months. But the defendants refused, rolling their dice and going to trial again.

Bad move.

In March 2005, the second jury convicted the defendants of multiple counts of sexual penetration with a foreign object by intoxication. Nachreiner was acquitted of rape and two counts of sexual penetration by a foreign object.
I'm glad they were convicted.

Nachreiner was the one who inserted the pool cue into a limp Jane Doe, both in her vagina and anus. At other times, Nachreiner is dancing, flashing gang signs and mugging for the camera.

Real quality behavior.

Nachreiner was 23 when he got out of Chuckawalla Prison on June 18, 2008. He moved to Big Bear, and worked as a ski lift attendant.

That November, he was arrested for drunken driving. The DUI charges eventually were dismissed, and he pleaded guilty to reckless driving. But he was sent back to prison for five months because of the parole violation. He got out of Chino Prison in April 2009, and moved in with his aunt.
Keep it going.

As with his other jobs, he hasn't told this employer about his criminal record.

Hmmmm, do you think they'll find out? Is that even legal – for him to withhold that information?

Hundreds of comments have been left after the story on the paper's website, most tearing Nachreiner a new one.

My advice to this guy:

1. Shut up. Stop talking until you fully realize why what you did was wrong.
2. Drop the appeals.
3. Behave yourself. You don't want to get arrested again or go back to jail. You don't want to be on parole or probation.
4. Get on your knees and beg the good Lord for forgiveness. Find a good church.
5. Use legal intermediaries to beg your victim for forgiveness.
6. Explain to the media how you were wrong and tell them how you've changed.
7. Work, pay your taxes, and get involved in some form of charity.

Maybe your life can be redeemed.

[UPDATE November 2017: This post is from April of 2010. Comments on this person continue to trickle in, with people claiming to know him now. I don't think it is fair to post negative comments about how he is now, because he's not in the news anymore. If he gets in trouble with the law again, then of course I'll publish more comments on that. If you want to keep ME updated and share your experiences with ME, you can still write those in the comment window. I'm not not likely to publish them. It is my sincere hope that everyone involved in this matter is, or becomes, a positively contributing member of society.]

Dear Abby: Okay to Stay With a Sex Offender, But Dump a Self-Centered Husband

Okay, it has been way too long since I’ve discussed advice columns here. There has been plenty of material – and maybe I will go back and do some of them – but I couldn’t pass up this latest one from Dear Abby.

CONFUSED AND TORN IN ILLINOIS writes:

I have been in a relationship with "Wade" for six years.
Translation: I have been fornicating with Wade for six years, hoping he has been fornicating only with me, even though we’re not married.
He has gotten into trouble and can't be around children because he's a registered sex offender.
Hmmm. There are some details missing here. A sex offender could be someone who got caught going to a prostitute. Do you mean he is a child molester? Either way, as a man, it sure is nice to know that no matter what I do, I can still find a woman who will fornicate with me.

Okay, this is where it starts to get really good.
I have an 11-month-old daughter by him.
Genius! Make a baby with a registered sex offender who “can’t be around children”. Make a baby with someone who is not married to you. I’m surprised she is able to write.
I want to be with Wade and work our relationship out,
Translation: I have extremely low self-esteem, I don’t use the brain God gave me, and Wade gives me orgasms and/or makes more money than I do.
but if I do, I'll have to give custody of my daughter to my parents and live in my own place with him.
Gee, that’s a tough one. Abandon my daughter, or dump the sex offender who hasn’t bothered to marry me. Hmmmm. Oh, how to choose?!?

But wait – there’s more!
I'm in love with Wade, but I don't know if he loves or wants to be with me anymore despite the fact he keeps saying he wants to be with me.
The dude will say whatever he has to in order to keep your legs open, Einstein. Just like he probably says “I’ve lost my puppy… please help me find him” to little girls or boys he sees on the street.
Am I being silly for still wanting to be with him?

Silly? SILLY?!? No, no, no… there are much more appropriate words.

Dear Abby replies:
After six years with Wade, you are still single. You could be single forever.
That’s the first concern?!?
When you became a mother, life stopped being all about you.
Now that is very, very true.
What if you should become pregnant again? Is it fair to your parents to dump your daughter on them like an unwanted pet?
Still nothing about the danger Wade poses. At least she says...
What effect could it eventually have on the child?
To be raised by the grandparents? Hard to say – they are the same people who raised this woman who apparently has no maternal instinct whatsoever.
Do you fully understand that what you have in mind will isolate you from relatives and friends who have minor children?
What about how it could put those children in danger?
While I can't dictate what you should do with your life, I can say you're heading in the wrong direction. Please step back and rethink this.
She wrote in asking for your advice. Of course you can make suggestions. Geez. Have people really become so worried about being “judgmental” that they won’t even suggest that someone should choose their own child over a “registered sex offender” who “can’t be around children” because it is the right thing to do?

Later on in the same edition, THE SILENT PARTNER writes in:
I have been married for 12 years to the most self-centered man in the world.

Unless he kidnapped you and forced you to marry him at gunpoint, my guess is that he is still the same guy who turned you on enough to marry him 12 years ago. Back then, you told yourself he was “confident” and “interesting”. You probably didn't give nice guys the time of day.
He's an astute businessman and a good provider,
You see, she is unaware that women can provide for themselves, or that other kinds of men can be good providers, so she felt the need to marry a self-centered man.
The moment I start talking about things I think are important, he turns on his TV or shushes me.
Maybe you keep complaining about the same things – things he can’t do anything about and things you choose not to do anything about, or simply complaining about him.
How can I get him to stop ignoring me?
Get in shape, strip naked, and jump his bones. He will not ignore you unless he is gay, ill, or getting it on the side.

Notice Dear Abby’s response:
If after 12 years your husband still won't listen to you, have your lawyer talk to him.
She has no problem telling a woman who is hurt by her husband of 12 years’ self-centerdness to threaten divorce through an attorney, but can’t bring herself to tell a mother to protect her daughter from a man who may be a child molester. Through the looking glass, indeed.
